1. Key terms and definitions
1.1. The IT Club Loyalty Programme (hereinafter referred to as the Programme) is a comprehensive system of measures that regulates the relationship between the Organiser of the IT Club Loyalty Programme, the Partners of the IT Club Loyalty Programme and the Members of the IT Club Loyalty Programme, within which the Members have the opportunity to receive promotional / special offers of the Programme Partners for the purchase of goods / works / services.
1.2. The Organiser of the IT Club Loyalty Programme (hereinafter referred to as the Organiser) is a legal entity that organised the Programme and has exclusive rights to manage and develop the Programme, as well as its authorised representatives. The Organiser of the Programme is IT Events Corporation Limited Liability Company (EDRPOU code 41970065).
1.3. The Member of the IT Club Loyalty Programme (hereinafter referred to as the Member(s)) is a legally capable individual who is a resident of Ukraine and has reached the age of 18, has agreed to participate in the Programme by receiving and activating the IT Club Loyalty Programme Member Card, unequivocally agrees with the Rules of the IT Club Loyalty Programme and whose participation is confirmed by the Organizer.
1.4. Card of the Member of the ‘IT Club Loyalty’ Loyalty Programme (hereinafter referred to as the Member’s Card) is a virtual card of the Member of the ‘IT Club Loyalty’ Loyalty Programme in the information system and mobile application of the Organizer. The Member’s Card is provided to him/her exclusively through the relevant representative of the company-member of Lviv IT Cluster.
1.5. Application form of the Participant of the IT Club Loyalty Programme (hereinafter referred to as the Application Form) is a registration form in the relevant IT Club mobile application filled in by the Participant and is a confirmation of the person’s desire to become a Participant of the Programme, as well as confirmation of the Participant’s consent to the Rules of the IT Club Loyalty Programme and consent to the storage, processing by any means and use by the Organizer of the Programme of the Participant’s personal data contained in the Application Form.
1.6. Programme Partner (Partner) means a business entity, including an individual entrepreneur, which, in accordance with the terms of the Programme, provides Programme Members with preferential/promotional/special conditions for purchases of goods/services or other bonuses as a reward for participation in the Programme.
1.7. Loyalty ID is a unique number that is included in the Virtual Card on electronic media. The Loyalty ID is used to identify an individual as a Programme Member in order to determine his/her right to receive Rewards.
1.8. Reward means preferential/promotional/special conditions for the purchase/receipt of goods/services/works or other form of bonus to the Programme Participant, Partner in agreement with the Organizer, taking into account the provisions of these Rules and the current legislation of Ukraine. Receipt of a Reward under the Programme means a bonus/gift/purchase (purchase) of the above-mentioned benefits by the Member at a preferential/promotional/special price (with a discount from the existing prices, which is provided in accordance with the procedure established by these Rules) in accordance with the terms and conditions of the Programme and the current legislation of Ukraine.
1.9. Programme Hotline is a service provided by the Organizer to Programme Participants to resolve issues related to participation in the Programme. The contact details of the Programme Hotline are indicated on the website at 0800500336, as well as in the mobile application of the Programme and on the Programme Participant’s package.
2. General provisions
2.1. The Programme is an adhesion agreement within the meaning of Article 634 of the Civil Code of Ukraine.
2.2. The Programme is not a game of chance, lottery, or gambling service.
2.3. The Programme is valid at all points of sale (centres/representations) of the Programme Partners (information about the addresses of the Partners is available in the mobile application of the IT Club Loyalty Programme).
2.4.The Organizer has the right to suspend the Programme, cancel or change the terms of the Programme.
3. Rules of participation and registration in the programme
3.1. Only an adult individual who is an employee/subcontractor or subcontractor of a Lviv IT Cluster member company, who has correctly filled in the required fields of the Participant’s Application Form and agreed to the terms of the IT Club Loyalty Programme Rules, may become a Programme Member.
3.2. By filling in the Programme Member Application Form, an individual submits personal and contact details for registration in the mobile application of the Programme. Filling in and entering the data of the Participant’s Questionnaire into the information system is a prerequisite for full participation in the Programme.
Each Application Form contains mandatory fields marked with asterisks. Without entering information into the mandatory fields of the Application Form, the Participant’s registration in the Programme is not possible.
3.2.1 The following fields are mandatory:
– First name
– Surname
– Date of birth
– City of residence of the Participant
– Name of the company to which the Participant is related
3.3. The Questionnaire filled in and validated by an individual certifies his/her voluntary consent (permission) to the Programme Organiser to process (collect, register, accumulate, store, adapt, change, update, use, distribute (distribute, sell, transfer), depersonalise, destroy, etc. including using information (automated) systems) personal data of an individual and other data specified in this Questionnaire in order to personify an individual as a Programme Participant, including for participation in all promotions. including for participation in all promotions and events of an advertising nature, as well as consent to the transfer (dissemination) of his/her personal data to the Programme Partners and third parties (including personal data managers, foreign subjects of relations related to personal data) for the purpose of their processing, including for personal communications with the Participant, transfer and receipt of information. The Programme Participant may at any time refuse to receive such information by notifying the Organiser via the hotline or through electronic communication channels provided by the Organiser. By filling out and submitting the Application Form, an individual certifies that he/she is familiar with these Programme Rules, is aware that the personal data provided by him/her is entered into the information system – the Programme Participant Personal Database, and confirms that he/she is familiar with the rights granted to him/her as a personal data subject in accordance with Article 8 of the Law of Ukraine ‘On Personal Data Protection’ and the provisions of the current legislation. The questionnaire does not contain identification data of an individual, including passport numbers and identification codes. The Application Form completed and validated by an individual also confirms his/her agreement with all the terms and conditions and these Programme Rules.
3.4. The Participant undertakes to provide accurate and reliable data when filling out the Application Form, as well as to notify the Organiser in a timely manner of any changes regarding the information provided. The Programme Participant shall be responsible for the accuracy and relevance of the data specified in the Application Form, as well as for timely notification of their changes. The Programme Organiser is not obliged to verify the accuracy of the information provided in the Application Form.
3.5. The Participant’s data specified in the Application form is confidential. Access to the data shall be granted to the responsible persons of the Organizer and the Participant and other persons, including Partners, who have been granted access to this data on legal grounds. Also, this data may be provided at the request of law enforcement and/or other authorities in accordance with applicable law.
3.6.The Organizer undertakes to properly collect, store, process the data of the Programme Participants and use them within the framework of the Programme and these Rules.
3.7. The Programme Member has the right to register only one Membership Card for himself/herself. In case the Participant has several Membership Cards, the Programme Organiser reserves the right to deactivate all the cards of such Participant, leaving only one.
3.8. The Programme is designed exclusively for personal use by individuals – Programme Participants, the rights of the Programme Participant cannot be transferred, sold, received monetary compensation or alienated in any other way.
3.9. The Participant has the right to terminate his/her participation in the Programme by sending a notice to the following e-mail address: [email protected]. After the Programme Organiser receives such a notice, the Participant’s membership in the Programme shall be terminated and the Participant’s Card shall be blocked.
3.10.The Programme Organizer reserves the right to suspend or terminate the participation of any Programme Member in the Programme without prior notice by blocking the Membership Card in cases where the Member
– Violates the Programme Rules and/or other agreements between the Participant and the Programme Organizer;
– Provides the Programme Organizer with false or misleading information;
– Performs fraudulent and/or unfair actions with the card. The existence of fraudulent and/or dishonest actions may be determined solely by the Programme Organiser and is not subject to appeal.
4. Terms of participation of Partners in the Programme
4.1 Partners of the Programme are legal entities registered under the laws of Ukraine and individual entrepreneurs conducting business activities in Ukraine in accordance with the current legislation of Ukraine.
4.2. Partners who have confirmed their participation in the Programme in the manner prescribed by these Terms and Conditions and have undertaken to comply with them shall provide a discount/promotional/special offer – discount/bonus/gift – agreed with the Organiser. The sample Partner registration form is approved by the Organizer and placed in the public domain on the relevant Programme website.
4.3. In accordance with these Rules, to participate in the Program, the Partner shall:
– fill in the registration form specified in clause 4.2 of these Rules and agree to comply with these Rules.
– send to the email address [email protected] materials for placement in the mobile application (logo, advertising photos, address(es) of its outlets, working hours, contact phone numbers, website address, a brief description of the company or brand and copies of its registration documents.
– to place the IT Club Loyalty sticker provided by the Organiser
at the point of sale (office) – upon application of the Programme Member, to provide him/her with certain bonus/preferential/promotional conditions or gifts in accordance with these Rules.
– if for any reason the above preferential/promotional conditions or gifts were not provided, during the next visit of such a Member to the Partner, provide him/her with a compliment from the Partner in addition to the above-mentioned usual promotional conditions or gift.
4.4. In accordance with these Rules, the Partner shall have the opportunity to:
– place information about itself in the mobile application of the Programme in the relevant category of Partners
– place, according to the address specified by the Partner, information about the locations of the Partner’s outlets on the relevant map of Partners in the mobile application of the Programme
– position the Partner and its brand among the Programme Participants, provide conditions for the formation of a proper perception of the Partner by the Programme Participants.
4.5. The Organizer has the right to unilaterally terminate cooperation under the Programme if:
– in case of non-fulfilment/violation of the terms of these Rules by the Partner, after warning the Partner about the need to eliminate the violations and providing the Partner with a deadline for eliminating such violations, they have not been eliminated within the specified period.
– During one calendar year, a Partner will receive a total of 05 such warnings.
– in case of constant complaints of the Members about low-quality goods or services provided by the Partner.
4.6. In case of changes in the terms of the above terms of participation in the programme, the Partner is obliged to send a request to the Organizer to the e-mail address [email protected] 05 working days before the desired moment of implementation of such changes. The Organizer, in case of approval of such changes, shall make them in the information about the Partner in the mobile application of the Programme within five working days, or, in case of disagreement, shall refuse to make such changes to the Partner.
4.7. The Partner shall be fully responsible for the logo/brand provided to the Organizer for positioning in the Programme, as well as for the list of goods/works/services and their quality.
5. Other conditions
5.1. The Program Organizer, at its sole discretion, has the right to make any changes to the current Rules of the “IT Club Loyalty” Loyalty Program at any time, which shall be notified to the Program Members by posting the relevant information on the Organizer’s website. It is the responsibility of the Member to follow the changes in the Terms and Conditions of the IT Club Loyalty Program.
5.2.The Program Organizer is not responsible for the quality of goods, works and services sold (provided, rendered, performed) by the Program Partners.
5.3. In order to resolve disputes, the Participant must contact the Organizer and provide, at the request of the latter, all details of the transaction – date, description of the transaction, details of the Program Partner. The Organizer reserves the right to respond to the Participant’s request within 30 days.
5.4. The Program is a long-term program.

Form of consent:
- A questionnaire submitted to the Personal Data Owner using the Program application.
- Personal data base: The database of personal data of the participants of the “IT Club Loyalty” loyalty program.
- Categories of personal data processed:
- Surname, first name, gender, e-mail address and other information about the person reflected in the Application Form or provided by the person voluntarily. The Questionnaire does not contain identification data of an individual, including passport numbers and identification codes.
Purpose of personal data processing:
- Personalization of a person as a Program Participant, including for participation in all promotions and events of an advertising nature.
- Personal data processing actions that the Personal Data Owner is entitled to perform:
- Collection, registration, accumulation, storage, adaptation, modification, renewal, use, distribution, depersonalization, destruction, etc. Including the transfer (dissemination) of personal data to the Program Partners, personal data managers, third parties, foreign subjects of relations related to personal data, which are determined by the Contractor independently, for the purpose of processing them, including for personal communications with the Participant, transferring and receiving information. The Participant agrees that the Personal Data Owner is not obliged to notify the Participant of the actions taken to process the Participant’s personal data in accordance with the purpose and objectives of their processing. Personal data may be processed in files and/or through an information and telecommunication system.
Notification of the rights of the personal data subject:
By providing his/her personal data by filling out the Questionnaire, the person thereby confirms that he/she is aware that the personal data provided by him/her is entered into the information system – the Database of personal data of the participants of the IT Club Loyalty Program, and also confirms familiarization with the rights that are granted to him/her as a subject of personal data according to Art. 8 of the Law of Ukraine “On Personal Data Protection” and the provisions of the current legislation are granted to him/her as a personal data subject.The Participant undertakes to provide accurate and reliable data when filling out the Questionnaire, as well as to timely notify the Personal Data Owner of changes regarding the information provided.
The period for which consent (permission) to process personal data is granted:
- Consent (permission) to process personal data is granted to the Personal Data Owner for an indefinite period, namely for the period (term) of the IT Club Loyalty Program, in which the person becomes a member.
Warning:
Failure of a person to provide consent to the processing of his/her personal data under the above conditions, or withdrawal of the consent provided by the person, makes it impossible for him/her to register and further participate in the IT Club Loyalty Programme.
